The biggest question that people call and ask is, “What is my case worth? What can I settle my case for?” And that answer is very difficult because you have to have a lot of information. And so, what we have to first do is get all your medical records—we need to get the MRI results, we need to find out what kind of treatment have you already had, and what kind of treatment are you going to need in the future? When an insurance company is going to settle your case, they’re going to give you money based on what they think they’re going to pay in the future; so, if the doctor is recommending another surgery, then obviously they will have to offer you more money to cover those expenses in the future. The other thing that we have to look at is the wages: how much wages do they owe you in the past, how much wages are they going to pay you in the future, and how long is that going to continue? Because the value of those lost wages will help determine how much money the insurance company has at risk for the future, and how much money that insurance company might have to pay you in the future. So, once we get all that information, then we usually have a conference call with our clients, or have them come into the office, explain all that information, come up with a plan, come up with a demand—how much money we’re going to ask from the insurance company—and then we go to mediation, and we try to get the most money possible to settle your case.
