Employment History and Social Security Disability Benefits

As an experienced disability attorney will tell you, employment history is a critical factor when applying for Social Security Disability benefits. Social Security will want to know about all the jobs a person has held over the last 15 years to see if a person can return to any past jobs or have transferable skills to move into a position that may be less physically or mentally demanding. You will have to complete form SSA-3369-BK, which will ask for a detailed description of what each job entailed. Form SSA-3369-BK will also ask how much weight you were required to lift on the job and the amount of time you engaged in activities such as sitting, standing, walking, and bending.
Two individuals with the same medical conditions can have two completely outcomes of their case based on their employment history. For example: Let’s take a 55-year-old gentleman whose past work includes only medium-level jobs in construction compared to a 55-year-old gentleman whose past employment includes sedentary work in an office setting. Both suffer from back pain. Based on their Residual Functions Capacities (RFCs), their doctors determine that they can only perform full sedentary work. The gentleman who has never performed sedentary duty will be eliminated from returning to past work and could be approved for benefits if he lacks transferable skills. However, for the man who performed sedentary work in the past, it may be determined that he can return to past work and be denied benefits.
