Is the workers’ compensation insurance the only way out for a workplace injury?

You might have heard or experienced people saying that if you suffer a workplace injury, workers’ compensation insurance is the only option or the best option available that you can resort to. However, despite the truth in the statement, there are various other options available to an employee or worker who got injured at the workplace such as:

  • If a worker gets injured by a product or by a machine that is faulty, failed to work properly or was dangerous, the manufacturer of the product or machinery will be held accountable in case it knew about it and did not inform the business or the worker of the possible danger. The manufacturer would have to compensate the worker for things like medical bills, lost wages, and pain and suffering.
  • Sometime the nature of work involves the use of harmful and toxic substances which can cause illness or severe injuries. Usually these chemicals include such things as asbestos, benzene, chromium compounds, silica, and radium, but any substance that harms the worker could possibly be the subject of a lawsuit for a “toxic tort.”
  • Some employers hurt the workers on purpose due to personal grudges or any other reason. If this happens, the employee has the right to sue the employer and if he turns out to be successful. The worker would receive even more compensation as compared to what he would have got under workers’ compensation claim.
  • If your employer does not have workers’ compensation insurance coverage, you have the right to sue him in the civil court if any injury happens. Though these kinds of cases get more compensation as compared to the workers’ compensation, but the responsibility of proving the employer at fault lies on worker’s shoulders.
