So usually, right after an accident, the employer or the insurance company will request that they take a statement from you. Many times, this statement is a recorded statement where a field adjuster will come to you or get you on the phone and actually record them asking you questions about what happened on the day of the accident. Most people just don’t—they don’t have an attorney at that point, and they just go ahead and give the statement and, I think, too much about it. If a client calls us, we don’t have our clients do… record a statement, because the recorded statement is not—not required by law; so, you don’t have to give this recorded statement. And many times, the insurance company will eventually do a deposition of our clients where they ask the same exact questions. So, we tell the insurance company, “Look, we’re not going to do a recorded statement when you’re going to just do the deposition and ask the same questions later.” There’s no reason to make our clients have to sit through both. So, if somebody calls you because they want to take a recorded statement, I would recommend calling us, and we will definitely tell you not to do the recorded statement, and—because it’s not necessary—so. But many people don’t know that because they haven’t spoken to an attorney yet, and the adjuster just calls them, and they just don’t ask enough questions. So, if you have that situation, give us a call, because that usually happens right away after the accident, and you don’t want to give a statement when maybe you forget something or you’re not really paying that much attention. Some people are giving statements while they’re driving, or while they’re watching TV or not paying attention; and then, if I find out later that they forgot something, and now the insurance company is using that against them—and so, we don’t want our clients to have that situation.
